Depending on the influence of historical events, the ongoing Chinese civil
law codification is hugely inspired by Roman law, constituting the most
recent development of Roman-Civil law system. The form adopted by Chinese legislator falls within the intermediate zone between codification and
compilation, which presents the same characteristics as the Codex, Digest and Institutions of Justinian. As for the sources of law, the current codification
of Chinese existing civil legislations and judiciary interpretations is also on
line with the Roman model of duality of ius civile and ius honorarium and their
fusion through the codification.
