Osservazioni a margine dell'interdetto quo ex castello: il ruolo del castellum aquae nella distribuzione delle acque condotte

This paper aims at analyzing the interdict quo ex castello and the related Ulpian’s commentary (Ulpianus 70 ad ed. D. 43, 20, 1, 38-44) in which the jurist gives a lot of important information about private individuals’ right to conduct water from the aqueduct. This work describes the structure and working of the castellum aquae, basing on the legal, literary and archaeological sources available, in order to focus on the general lines of conducted water distribution. There are some important pending issues: for example, the relationship between the concession of ius aquae ducendi and the structures for water distribution, especially fistulae, and the problem of making a comparison among different sources, which must be done with great caution.
