L’appello al principe dalle città dell’Impero nell’opera di Papirio Giusto (D.49.1.21pr.-3)*
In: Codex: 3, 2022
After a clarification concerning the fragments of the work of the jurist Papirius Justus contained in the Digest of Justinian, as well as the role he played in the transition from the jurisprudential to the legislative conception of law, we examine some imperial constitutions of Marcus Aurelius and Lucius Verus contained in a fragment of his work, relating to the process, and in particular to particular hypotheses of appeal to the prince from the civitates of the Empire, coming to the conclusion that the fragment in question confirms the systematic order, and not chronological, of the work of Papirius Justus, as well as its highly innovative character in the panorama of legal sources of the second century.
