Formulae and proceedings before Roman courts
The “jurist’s villa” with its unusual decorations stimulates new discussions in specialist doctrine. Attention is focused on the meaning of the legal term formula. The formulae had a central meaning in the trial that took place before the magistrate, and in them the data of the ongoing dispute were summarized: the appointment of the iudex, the claim of the plaintiff, the possible exceptiones of the defendants and the authorization to judge. The jurisdiction of the Imperium Romanum was resolved in the formalization of this scheme, both in Rome, the center of the administration, and in the provinces. The word ‘formula’ is also mentioned in some documentary texts: in the tabulae ceratae and in the papyri. In my contribution, I would like to introduce some sources that can explain the use of the word in different contexts.

Die ‚Villa del Giurista‘ regt mit seinen ungewöhnlichen Dekorationen neue Diskussionen in der Fachwelt an. Im Mittelpunkt steht die Bedeutung des juristischen Fachwortes formula. Formulae haben im Prozess vor dem Prätor eine zentrale Bedeutung gehabt; in denen wurde das Beweisprogramm des aktuellen Rechtsstreits zusammengefasst: die Ernennung des iudex, das Begehren des Klägers, die eventuelle Einreden des Beklagten, und die Ermächtigung zum Urteilsspruch. Die Jurisdiktion des Imperium Romanum lief sowohl im Verwaltungszentrum Rom als auch in den Provinzen durch dieses formalisierte Schema. Das Wort ‚‘formula’ ist auch in einigen dokumentarischen Texten erwähnt: in den tabulae ceratae und in den Papyri. In meinem Beitrag möchte ich einige Quellen vorstellen, die den Gebrauch des Wortes in verschiedenen Kontexten erklären können.

La ‘villa del giurista’ con le sue decorazioni insolite stimola nuove discussioni nella dottrina specialistica. L’attenzione si concentra sul significato del termine giuridico ‘formula’. Le ‘formulae’ hanno avuto un significato centrale nel processo che si svolgeva davanti al pretore, e in esse erano sintetizzati i dati della controversia in atto: la nomina del iudex, la pretesa dell’attore, le possibili exceptiones dei convenuti e l’autorizzazione a giudicare. La giurisdizione dell’Imperium Romanum è stata risolta nella formalizzazione di questo schema, sia a Roma, centro dell’amministrazione, che nelle province. La parola ‘formula’ è anche menzionata in alcuni testi documentari: nelle tabulae ceratae e nei papiri. Nel mio contributo, vorrei introdurre alcune fonti che possono spiegare l’uso della parola in contesti diversi.
