
Tradurre istituti, veicolare concetti. Resistenze e aggiustamenti dogmatici nel Codice civile cinese

The essay, starting from the recognition of the importance of translations in the legal field, focuses on the particular difficulty of translating from Chinese. Linguistic peculiarities require a transfer of concepts between the source language and the target language, as it is not possible the terminological cast. Three points have been touched upon, ranging from the notion of contract, oscillating in China between the terms ‘hetong’ and ‘quiyue’; the notion of real contract, which in China has met with interesting resistance, against various choices made by other legislators, and albeit not without dogmatic fluctuations; and the legal lexicon on the subject of predial servitudes.
